5:30 p.m. Prescott Valley Regular Town Council Meeting.  Agenda item 10.a. is Proposed Repeal of Ordinance No. 2023-930 Water Requirements Non-Subdivision Residential Developments (2nd Reading). On Jan. 11, 2024, the Town Council adopted Ordinance No. 2023-930 requiring non-subdivision residential developments in the Town to obtain commitments for renewable water supplies (i.e., effluent interests, available extinguishment credits, etc.) or imported water supplies as a condition precedent for any Town approvals. The Town has since been notified by the Goldwater Institute that it believes Ordinance No. 2023-930 conflicted with the Arizona Groundwater Management Act. Goldwater also disagreed with the Town’s position that it had sufficient authority to enact the Ordinance. The Goldwater Institute requested that the Town Council consider rescinding the Ordinance or face litigation by affected property owners. The Oct. 22 council agenda stated: "Town staff is recommending the repeal as a means of avoiding future expenditures required for legal or other defenses.” The council memo for this meeting states, “At its regular meeting on October 22, 2026, the Town Council voted to read Ordinance No. 2026-988 by title only on two separate occasions, then place the same on final passage. The Town Clerk then read the Ordinance for the first reading. It is now proposed that the Clerk read Ordinance No. 2026-988 by title only for the second reading, after which the Mayor will ask 'Shall this Ordinance Pass?' The Council will then vote on whether to adopt Ordinance No. 2026-988 repealing Ordinance No. 2023-930. If the vote were in favor of adoption, the repeal would become effective 30 days thereafter.” The agenda with options for remote viewing is HERE: LOCATION: Council Chambers/Library Auditorium, 7401 E Skoog Blvd.
